General terms and conditions for private commissionsThe following terms and conditions apply to private commissions between you as the client and me, Justine Barthel, as the illustrator. You do not have to sign them. The terms and conditions apply upon receipt of your order on the Ko-fi platform or after written confirmation of the order by me via email.Copyright and rights of useI, the illustrator:
…retain in all cases all ownership and copyrights to all commissioned or purchased works
…will NOT continue to profit from the commissioned work in the case of private use, unless you use the commissioned work unlawfully for commercial purposes
…reserve the right to publish the commissioned work online, in my portfolio or social media channels, as well as in print products
In the event of a violation of the rights of use, editing or naming rights, I am entitled to demand a contractual penalty depending on the severity of the violation, but at least in the amount of three times the agreed basic remuneration. The right to assert claims for damages, monetary compensation or other rights in addition to the contractual penalty remains unaffected.You the client:
…are granted the non-exclusive, non-transferable right, unlimited in time and space, to use the commissioned or acquired results for exclusively private purposes
…may publish the results of the order on private (non-commercial) profiles on the Internet, provided your name is mentioned
…may use the order results for the production of print products for exclusively private purposes
…may NOT use the results of the order for commercial purposes
…may NOT modify the results of the order without my consent
…may NOT pass on or sell the acquired rights of use to third parties
If you require rights of use for commercial purposes, please inform me when placing the order. The prices quoted do not apply in this case. Pricing is based on the rights of use required and is always a matter for negotiation. Any resulting deviating rights of use will be listed on your invoice and take precedence over those listed here.Copyright infringementsReproducing / using copyright-protected order results commercially – i.e. with the intention of earning money directly or indirectly.
Passing off or referring to the results of the order as your own.
Modifying the results of the order without my consent.
Publishing the results of the order without identifying me as the author.
Passing on the results of the commission to others in order to create a new work based on them.
